You really need to consult with a lawyer. I own an autobody shop and I buy autobody shops. If I purchase an autobody shop I usually assume the liability of that shop, (though this usually does nothing but cost me money, it builds a repoirte with the clientele) it depends on the clausory that is in the purchasing shops contract. If there is no assumption by the purchasing shop, then you will need to file a civil suit against the former owner.
The easiest way to find the former owner is to contact the current owner and find out who he bought it from. He will readily hand this information over to you when he understands your situation and you mention anything about a civil suit.
You also need to get a 3rd party autobody shop to write an estimate to fix the damage that was not fixed in the first place.
Some insurance companies, when faced with this problem for work that THEY actually paid to have done, will pay for the work to be fixed correctly and then go after the other party with their high powered lawyers. So, if this damage was settled with an insurance claim, I would let the insurance company who paid the claim know about the problem.
I hope that this helps you get the remedy that you deserve. Its shops like that which give us a bad name. I’m sorry for your experience.
